Terms of Service

The terms that apply to quotes, bookings and work performed by SOS'S Tree Services.

These terms

These terms apply to all quotes, bookings and work performed by SOS'S Tree Services. By accepting a quote or allowing us to commence work, you agree to them. Where a written quote or contract says something different, that document takes precedence.

Quotes

Quotes are free and given after an on-site inspection unless we have agreed otherwise. A quote is valid for 30 days and is fixed for the scope described in it.

Additional work discovered on the day, such as a second tree, concealed structural defects, or hazards not visible at the time of quoting, will be discussed with you and priced before we proceed. We will not do extra work and then invoice you for it.

Your responsibilities

Before we arrive, please confirm that you own the trees or have the owner's written authority to have them worked on, that any required council approval is in place unless we have agreed to obtain it, and that we have clear and safe access to the work area.

Please also secure pets, move vehicles from the work zone, and tell us about anything buried that we would not know about: reticulation, septic systems, private power or water runs, or anything similar. We locate services where we reasonably can, but we cannot be responsible for damage to unmarked private infrastructure we were not told about.

Access and site conditions

Our quotes assume the access conditions observed at the time of inspection. If access changes, for example a gate is locked, a vehicle blocks the driveway, or the ground is too wet to bring equipment on, we may need to reschedule and additional charges may apply.

Council approvals

You are responsible for obtaining any local government approval required to remove or prune a protected tree, unless we have specifically agreed in writing to obtain it on your behalf. We will advise you if we believe an approval is needed. We will not proceed with work we believe to be unlawful.

Safety and weather

We may postpone or stop work where conditions are unsafe, including high wind, lightning, extreme heat or unstable ground. We will reschedule as soon as it is safe. Safety decisions on site rest with our crew leader and are not negotiable.

Clean-up and green waste

Unless the quote says otherwise, all green waste generated is removed from site and recycled. If you want mulch retained, tell us before we start and we will leave a pile in an agreed location at no charge. Timber left for firewood is quoted separately.

Stump grinding

Stump grinding is only included where the quote says so. Standard grinding is to approximately 300mm below existing grade. Grindings are left on site and backfilled unless removal was quoted. We locate services before grinding, but we cannot be responsible for damage to unmarked private infrastructure.

Payment

Residential work is payable on completion unless other terms have been agreed in writing. Commercial and strata accounts are net 14 days from invoice. Larger jobs may require a deposit, which will be stated on the quote. Overdue accounts may attract reasonable recovery costs.

Cancellation

Please give us at least 24 hours notice if you need to cancel or reschedule. Cancellations inside 24 hours, or where our crew arrives and cannot access the site, may attract a callout fee reflecting the mobilisation cost.

Insurance and liability

We carry $20 million public liability insurance, workers compensation and professional indemnity cover. Certificates of currency are available on request.

We take responsibility for damage caused by our negligence. We are not liable for pre-existing damage, for damage to unmarked private underground services, for normal minor lawn marking from equipment, or for consequential loss. Nothing in these terms excludes any rights you have under the Australian Consumer Law.

Emergency work

After-hours emergency work is charged at our callout rate, which we will tell you before we attend. Emergency attendance is a make-safe service focused on removing immediate danger. Full removal, stump grinding and complete site clean-up are normally scheduled separately at standard rates.

Photographs

We may photograph work for our records and occasionally for marketing. We will not publish images identifying your property without your permission. Tell us if you would prefer we did not photograph your job.

Governing law

These terms are governed by the laws of Western Australia.
